Liberty Protection Safeguards
The Mental Capacity (Amendment) Act 2019 introduces Liberty Protection Safeguards (LPS), a new scheme which will replace the current Deprivation of Liberty Safeguards (DoLS) arrangements.
LPS will provide protection for people aged 16 and above who are or who need to be deprived of their liberty in order to enable their care or treatment and lack the mental capacity to consent to their arrangements, in England and Wales. At present the new scheme is due to be implemented in April 2022.
In Salford, work is ongoing to prepare for this significant change and is being led by a LPS Steering Group which has been established.
A draft code of practice is due to be published for consultation in June 2021.
